Categories of Employees Covered by the Law

Under Cyprus employment law, employees are categorized and protected based on specific regulations. This includes full-time, part-time, temporary, and casual workers, as well as those employed on fixed-term contracts. Each category has distinct rights and obligations, which we can help you understand and enforce, ensuring fair treatment in the workplace.

Employment Contracts

An employment contract is the cornerstone of the employer-employee relationship. It sets out the terms and conditions of employment, including salary, benefits, working hours, and duties. We ensure that your employment contracts are compliant with Cypriot law, offering legal protection for both employers and employees. We also provide advice on amending or terminating contracts as necessary.

Notice of Termination

In Cyprus, the notice period for termination depends on the employee's length of service. Employees with less than 26 weeks of service are not entitled to notice, while those with longer service are entitled to a notice period ranging from 1 to 8 weeks.

Probation Period

If an employee is on probation, the employer may terminate the contract without notice. Recent changes in the law (effective from 13/04/2023) limit probation periods to 6 months. Employers may also opt to pay the employee the equivalent of the notice period instead of providing notice.

Employee’s Obligation to Give Notice to the Employer

Employees are also bound by the requirement to give notice if they wish to resign. The length of the notice period depends on the length of service. For instance, an employee with fewer than five years of service must provide at least two weeks’ notice. Our team provides advice to employees on how to comply with these legal obligations and avoid potential disputes with employers.

Grounds for Termination

Termination in Cyprus must be based on valid legal grounds, such as redundancy, misconduct, poor performance, incapacity, or other justifiable reasons. Employers must ensure procedural fairness during the process. Employees are not entitled to compensation in cases of redundancy, force majeure, the end of a fixed-term contract, reaching retirement age, or when the termination is due to their own fault (e.g., poor performance, misconduct etc.).

Unfair Dismissal

An unfair dismissal occurs when an employee is dismissed without just cause or when the employer fails to follow the proper procedures. Under Cypriot law, employees who believe they have been unfairly dismissed have the right to challenge the decision in court. We help employees who are facing unfair dismissal and provide legal representation for claims against employers.

Employee’s Right to Compensation for Unlawful Dismissal

Employees unlawfully dismissed after 26 weeks of service are entitled to compensation, calculated based on their length of service. Compensation also applies if the employee leaves due to the employer’s conduct. Employees over 65 are not eligible. The Labour Disputes Court decides the amount, considering factors like salary, service, and dismissal circumstances.
